1. Introduction
These Terms of Use apply to the Bob the Physio website, mobile application, rehabilitation programmes and related services (“Services”).
By creating an account, purchasing a programme or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.
2. Services Provided
The Bob the Physio app provides exercise-based rehabilitation programmes for common back and neck conditions, including back pain, neck pain, sciatica, disc bulges and herniations, spinal stenosis, spondylolisthesis and related symptoms.
Depending on the programme purchased, the Services may include:
- Guided exercise and mobility videos;
- Progressive rehabilitation programmes;
- Daily activity and symptom tracking;
- General feedback based on information entered by the user;
- In-app support and rehabilitation guidance; and
- Access to an optional members-only support community.
The app provides general rehabilitation guidance. It does not provide individually prescribed physiotherapy unless you separately book an online or in-clinic consultation.
3. Medical Disclaimer
The app is not an emergency service and does not replace an individual medical assessment, diagnosis or treatment from a doctor, physiotherapist or other qualified healthcare professional.
You are responsible for ensuring that exercise is suitable for your health, physical ability and medical condition. You should obtain medical clearance before using the app if you have a serious medical condition, recent major trauma, progressive weakness, unexplained severe or constant night pain, or other significant health concerns.
Stop exercising and seek appropriate medical assistance if you experience:
- Severe or worsening pain;
- New or progressive weakness or numbness;
- Chest pain, breathing difficulty or dizziness;
- Loss of bladder or bowel control;
- Numbness around the groin or saddle area; or
- Any other new or concerning symptoms.
In an emergency, contact your local emergency services immediately.
In-app feedback, automated recommendations and support messages provide general information only. They do not constitute continuous medical monitoring, an individual medical assessment or emergency medical advice.
Results and recovery times vary between individuals. Bob the Physio does not guarantee any particular improvement, result or recovery timeframe.
4. User Responsibility and Limitation of Liability
You use the app and perform all exercises at your own discretion and risk. You are responsible for deciding whether a programme or exercise is suitable for you.
To the fullest extent permitted by law, Bob the Physio will not be responsible for any injury, pain, worsening of symptoms, loss or damage resulting from:
- Performing an exercise incorrectly;
- Continuing despite pain, worsening symptoms or warning signs;
- Ignoring instructions, precautions or contraindications;
- Providing inaccurate or incomplete health information;
- Using equipment incorrectly;
- Exercising in an unsafe environment;
- Using a programme that is unsuitable for your condition; or
- Using the app without obtaining appropriate medical clearance.
Nothing in these Terms excludes or limits liability where it cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or any mandatory consumer rights.
5. Eligibility and Accounts
You must be at least 18 years old to create an account or purchase a programme.
Anyone under 18 may use the Services only with the consent and supervision of a parent or legal guardian and appropriate professional guidance.
You agree to:
- Provide accurate and complete information;
- Keep your login details secure;
- Notify us if your account may have been accessed without permission; and
- Accept responsibility for activity conducted through your account.
Your account and purchased programmes are for your personal use only. They must not be shared, sold or transferred to another person.
We may suspend or terminate an account that is used fraudulently, unlawfully or in serious or repeated breach of these Terms.
6. Using the Programms
When using the Services, you are responsible for:
- Following the exercise instructions and safety guidance;
- Starting at an appropriate exercise level;
- Using suitable equipment;
- Exercising in a safe environment;
- Providing accurate health and progress information; and
- Seeking professional advice if you are uncertain whether an exercise is suitable.
You must not rely solely on the app to diagnose, treat or manage a medical condition.
You should not perform an exercise if you cannot do so safely or if it causes severe, unusual or progressively worsening symptoms.
7. Purchases and Programme Access
Prices and programme details are displayed before purchase. Payments may be processed through Apple, Google, Stripe or another authorised payment provider.
Unless otherwise stated, programme purchases are one-time payments and not recurring subscriptions.
A purchase gives you a limited, personal and non-transferable right to access and use the selected programme in accordance with these Terms.
We may update, improve or replace exercises, videos and app features to maintain or improve the safety, quality and operation of the Services.
8. Cancellation and Refunds
You may request cancellation within 14 days of purchase.
Because access to the rehabilitation programme is provided immediately, refunds may not be available once you have accessed, viewed or started the programme, except where required by applicable consumer law.
Purchases made through Apple’s App Store or Google Play must be submitted through the relevant platform and are also subject to that platform’s refund procedures.
To request cancellation for a purchase made directly through Bob the Physio, email [email protected] within 14 days of purchase.
Nothing in this policy affects your mandatory statutory consumer rights.
9. Acceptable Use
You must not:
- Copy, download, record, reproduce or distribute app content without permission;
- Share, sell or transfer your account;
- Resell or commercially use a rehabilitation programme;
- Allow another person to use your purchased programme;
- Attempt to bypass security or payment controls;
- Reverse-engineer, damage or interfere with the app;
- Upload unlawful, harmful or misleading material; or
- Use the Services in a way that infringes another person’s rights.
We may suspend or terminate access where these rules are seriously or repeatedly breached.
10. Intellectual Property
All rehabilitation programmes, videos, exercise plans, text, images, graphics, logos, branding and other content are owned by or licensed to Bob the Physio and are protected by intellectual-property laws.
You receive a limited, personal, non-exclusive and non-transferable licence to use purchased content for your own rehabilitation.
No content ownership or intellectual-property rights are transferred to you. You may not reproduce, publish, sell, teach, distribute or commercially exploit the content without prior written permission.
11. Availability and Technical Requirements
We aim to keep the Services available and functioning correctly. However, uninterrupted, secure or error-free access cannot be guaranteed.
Temporary interruptions may occur because of maintenance, updates, security issues, internet failures or circumstances outside our reasonable control.
You are responsible for maintaining:
- A compatible device;
- A reliable internet connection;
- An up-to-date operating system; and
- The current version of the app.
12. In-App Support and Community
In-app messages and community discussions are intended to provide general support and information. They are not a substitute for an individual consultation and must not be used for emergencies.
The members-only support community is intended for users who have purchased a programme. Members must communicate respectfully and must not:
- Provide medical diagnoses or individual treatment instructions to other members;
- Advertise or promote unrelated products or services;
- Share another member’s personal information or content without permission; or
- Post abusive, misleading, discriminatory or inappropriate content.
We may remove content or restrict community access where these rules are breached.
13. Privacy
Personal information, including health-related information submitted through the app, is handled in accordance with our Privacy Policy.
By using the Services, you confirm that you have reviewed the Privacy Policy.
14. Third-Party Services
The Services may contain links to or rely on third-party platforms, including payment processors, app stores, booking systems, analytics providers or video services.
Those third parties operate under their own terms and privacy policies. Bob the Physio is not responsible for the independent operation or content of third-party services.
15. Changes to the Services or Terms
We may update these Terms when the Services, legal requirements or business practices change.
The updated Terms and effective date will be displayed on the website or in the app. Where a change materially affects your rights, reasonable notice will be provided where required by law.
Continued use of the Services after the updated Terms take effect constitutes acceptance of those Terms, subject to any mandatory rights available to you.
16. Governing Law
These Terms are governed by the laws of Ireland.
The Irish courts will have jurisdiction over disputes relating to these Terms. This does not affect any mandatory consumer rights or protections available to you under the laws of the country in which you live.
